West Ham United Ticket Trader Scheme

The Ticket Trader facility is offered to current season ticket holders where matches have sold out.

Season ticket holders are able to use the Ticket Trader facility at WHUFC online Box Office to "post" their seat for resale, at which time the seat becomes available for general sale.

In the event of a successful resale the season ticket holder will receive an account credit that can be used for future ticket purchases.

Terms and Conditions

1) These Terms and Conditions ("Agreement") list the terms of the agreement between you and West Ham United Football Club plc ("West Ham") for selling season ticket seats ("Tickets") for individual matches where you are unable to attend, and all other services that West Ham provide (the "Services"). By using this online only, ticket trader facility you agree to accept this Agreement.

2) West Ham provides an online only service for current season ticket holders of West Ham who want to sell their own tickets ("Sellers") to individuals seeking to buy them ("Buyers"). West Ham does not take title to the underlying ticket. West Ham only verifies the tickets that are sold and purchased and provides payment and fulfillment services. It does not guarantee that it can find a Buyer and will have no liability to traders in the event that it does not.

3) If West Ham changes this Agreement, it shall post a revised version of this Agreement, which shall automatically replace the terms of this Agreement. The revised version of this Agreement is automatically effective seven (7) days after it is initially posted on the Site. Your continued use of the Site and the Services following West Ham's posting of a revised Agreement will constitute your acceptance of the revised Agreement. If you do not agree with the terms of this Agreement or any revised version of this Agreement, do not continue to use the Services or this Site.

4) The Services will only be offered at West Ham's sole discretion and Seller's seats will only be made available for sale to Buyers when (in West Ham's sole discretion) all available match Tickets (excluding any Visitors allocation) have been sold and the Ticket Trader advertised on West Ham's website. Ticket Trading will not be offered for special promotion games such as "Kids for a Quid" and "Youth Academy"

5) Once the Seller lists tickets for sale and a Buyer purchases the tickets, the Seller's tickets will be cancelled for that particular match only (even if it is subsequently re-arranged due to poor weather, police advice or for television scheduling reasons).

6) Sellers are entitled to withdraw their ticket at any time prior to it's traded resale. Provided that this is done online on West Ham's website. In the event that a Ticket remains unsold the holder will be free to use the ticket as normal. Traded tickets will automatically be deemed unsold if no sale is made before 9am on the morning of the game and the Ticket will be reactivated from that time and only the original season ticket holder can thereafter attend.

7) WHU bears no responsibility for tickets being traded and sold without the consent of the holder e.g. in the event that the holder's online security is breached.

8) The value of the credit will be calculated as follows "amount of the discounted cost for that particular category match as built into the price of the season ticket". The credit values are shown below in this agreement provided that the Ticket has been bought by a Buyer. Sellers will be able to see the status of their ticket and their account balance online. Sellers will be contacted by email:- · when Ticket Trader has been activated for a particular fixture, and/or · if traded tickets have been resold or subsequently if that ticket is refunded and made available for resale again Whilst Sellers will be kept informed about the trading by email in the (2) circumstances set out above, responsibility for checking availability shall always remain with the Seller and West Ham will accept no liability if no email is received for any reason. (for example but not limited to incorrect or out of date email addresses).

9) Proceeds from the sale of the a Seller's seat will be credited to an "e-purse account" This can be used for buying home match (i.e. those taking place at Upton Park) tickets for either individual games or against future season tickets. Account credits can only be used by Sellers after the traded match has been played

10) In the event of a successful resale the Seller has no claim on the seat for that match and in the event that the Seller wishes to attend a match then they will have to purchase an alternative match ticket (subject to availability) at the full price.

11) All sales are final. No refunds, cancellations or exchanges will be issued for date or time changes, partial performances, or loss.

12) Sellers, Buyers and West Ham are independent contractors, and no agency, partnership, joint venture, employer-employee or franchisor-franchisee relationship is intended or created by this Agreement.

13) This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales. You consent to the exclusive personal jurisdiction and venue of English courts.

14) Event dates, times, venues and subject matter, which are listed on the ticket, may change. It is up to the Seller to verify the most recent changes by contacting the Ticket Office or referring to official listings for any changes.
